Notice of Proposed Sale of Land – Gallaghers Lane
Baw Baw Shire Council (Council) hereby gives notice under Section 114 of the Local Government Act 2020 (Act) and Council’s Community Engagement Policy of its intention to sell the part of discontinued road reserve known as Gallaghers Lane, Yarragon South (Lot 1 on Title Plan No. 906152N (part only)) subject to Council approval (STCA).
On the 8th of August 2019 Council advertised a Road Discontinuance Gazettal Notice under Section 206 and Clause 3 of Schedule 10 of the LGA 1989, this followed a resolution at Councils ordinary meeting to discontinue this section of road.
Council proposes to sell the land to the adjoining neighbours as per occupation – in accordance with the council resolution to discontinue this part of the unused road. Letters have been sent to the three adjoining landowners requesting an expression of interest to purchase the four sections of land as per the survey plan attached.
The community is invited to comment on this proposal.
Any person wishing to make a submission on this proposal must do so by Friday 7 March 2025. All submissions will be considered in accordance with Council’s Community Engagement Policy.
Submissions should be addressed to the Chief Executive Officer (CEO) and can be hand delivered to Council’s office at 33 Young Street, Drouin, emailed to baw.baw@bawbawshire.vic.gov.au or posted to PO Box 304, Warragul VIC 3820.
Any person requesting to be heard in support of their written submission is entitled to be heard before Council (or a committee established by Council for this purpose) or be represented by a person acting on their behalf and will be notified of the time and date of the hearing.
