Notice of Intention to Create an Easement on Land

Baw Baw Shire Council (Council) gives notice under section 114(2)(b) of the Local Government Act 2020 (Act) and Council’s community engagement policy, that it intends to create a carriageway easement over the part of the land contained in certificate of title volume 3428 folio 422, known as Permewan Lane as shown on the plan below.

The proposal is that the Easement be created in favour of Alfred Street Development Pty Ltd ABN 663100721 (Purchaser) as per condition 18 on the issued Planning Permit on the land (PLA0189/23).

A person may make a submission on the proposal.

Any person proposing to make a submission must do so by 5pm on 7 August 2024.  All submissions will be considered in accordance with Council’s community engagement policy.

Submissions should be addressed to the Chief Executive Officer, and can be hand delivered to Council's Office at 33 Young Street, Drouin, emailed to Bawbaw@bawbawshire.vic.gov.au or posted to the following address:

Any person requesting to be heard in support of their submission is entitled to be heard before Council (or a Committee established by Council for this purpose) or be represented by a person acting on their behalf, and will be notified of the time and date of the hearing.
